Welcome to Honey Needle ("Honey Needle," "we," "our," or "us"). Honey Needle is an online marketplace and mobile application that enables independent creators to showcase and sell handmade goods to customers.
By accessing or using our website, mobile application, or services (collectively, the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
1. Eligibility
You must be at least 18 years old to create an account and use Honey Needle as a seller. By using the Services, you represent that you have the legal capacity to enter into a binding agreement.
2. Marketplace Role
Honey Needle provides a platform that connects buyers and independent sellers.
Sellers are solely responsible for their listings, products, shipping, and compliance with applicable laws.
Honey Needle does not manufacture, inspect, or guarantee any items sold through the platform.
Honey Needle is not a party to the contract between buyer and seller.
3. Handmade Policy
All products listed on Honey Needle must be handmade, custom-made, artist-designed, or otherwise meet our handmade standards.
Prohibited listings include:
Mass-produced items
Dropshipped products
Counterfeit goods
Illegal or prohibited items
We reserve the right to remove listings or suspend accounts that violate this policy.
4. Seller Responsibilities
Sellers agree to:
Provide accurate product descriptions and photos.
Fulfill orders within the stated processing time.
Maintain accurate inventory and pricing.
Comply with tax, customs, and consumer protection laws.
Resolve customer issues in good faith.
Sellers are responsible for:
Product quality
Packaging
Shipping
Import/export compliance
Taxes owed in their jurisdiction
5. Buyer Responsibilities
Buyers agree to:
Provide accurate shipping and payment information.
Review listing descriptions and shop policies before purchasing.
Contact sellers promptly regarding order issues.
Buyers are responsible for any customs duties, VAT, import taxes, or other charges imposed by their country.
6. Payments and Fees
Honey Needle processes payments through third-party providers such as Stripe.
By selling on Honey Needle, sellers agree that:
Honey Needle may deduct platform fees and payment processing fees from order proceeds.
Shipping label costs may be deducted from seller payouts if labels are purchased through the platform.
Payouts are subject to payment processor timing and reserve policies.
Honey Needle currently charges a platform fee of [10%] per completed sale, subject to change with notice.
7. Shipping
Sellers are responsible for shipping products to buyers.
Where available, Honey Needle may provide shipping labels through integrated third-party providers such as Shippo or EasyPost.
Honey Needle is not responsible for:
Carrier delays
Lost packages
Customs delays
Incorrect addresses provided by buyers
8. Returns and Refunds
Because many items are handmade, custom-made, or one-of-a-kind, all sales are generally final unless otherwise stated by the seller.
If an item arrives damaged, materially different from the description, or with undisclosed defects, buyers should contact the seller first.
If the issue cannot be resolved, buyers may contact Honey Needle at contact@honeyneedle.com within 7 days of delivery.
Honey Needle may, at its sole discretion, facilitate refunds or other resolutions.
9. Cancellations
Orders may only be canceled if the seller agrees and production has not begun.
Custom and made-to-order items are generally non-cancelable once work has started.
10. Intellectual Property
Users retain ownership of the content they upload, including photos, product descriptions, and designs.
By posting content, you grant Honey Needle a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and promote your content in connection with operating and marketing the Services.
Users may not upload content that infringes another party's intellectual property rights.
11. User Content and Conduct
Users agree not to:
Post false or misleading information
Infringe intellectual property rights
Harass or abuse others
Circumvent Honey Needle fees
Upload harmful code or malware
We reserve the right to suspend or terminate accounts that violate these Terms.
12. Account Suspension and Termination
Honey Needle may suspend or terminate accounts for any reason, including:
Violation of these Terms
Fraudulent activity
Chargebacks
Handmade policy violations
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
Honey Needle does not guarantee:
Continuous availability
Error-free operation
Product quality or suitability
Seller performance
14. Limitation of Liability
To the fullest extent permitted by law, Honey Needle shall not be liable for indirect, incidental, consequential, or special damages.
Honey Needle's aggregate liability shall not exceed the greater of:
The amount you paid to Honey Needle in the previous 12 months, or
$100.
15. Indemnification
You agree to indemnify and hold harmless Honey Needle and its affiliates from claims, damages, and expenses arising from your use of the Services or violation of these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
17. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in Colorado, except where prohibited by law.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
